These Terms govern your use of Mihwar and any Mihwar Pro purchase.

The agreement and app licence

These Terms form an agreement between you and Muhammad "Shaaf" Kashan, trading as Mihwar in the United Kingdom. Please read them before you use Mihwar or make a purchase.

Apple's Standard EULA is the licence for the iOS app. These Terms supplement Apple's Standard EULA with Mihwar's service and commercial terms. They do not replace that licence or any right given by the Consumer Rights Act 2015 or another law that applies to you.

What Mihwar provides

Mihwar is a local-first daily wellness and planning app for iOS. We provide the app with reasonable care and skill. Sections 34 to 36 of the Consumer Rights Act 2015 require paid digital content to be of satisfactory quality, fit for a particular purpose you made known and accepted, and as described.

If Mihwar does not meet those standards, sections 42 to 45 of that Act provide remedies that may include repair or replacement, followed by a price reduction or refund in the circumstances those sections set out. Your statutory rights are not affected by these Terms. The UK government's consumer-rights guidance explains how to obtain further advice.

No software is free from every interruption or error. This does not reduce the standards or remedies in the Consumer Rights Act 2015.

The AI companion

Mihwar's companion and planning features are generated on your device by the Gemma 2 2B language model. The companion is instructed not to issue religious rulings, quote scripture as authority, or give medical, legal or financial advice. AI output can be wrong. Treat it as a prompt for reflection rather than an authority.

For religious questions, consult a qualified scholar. For health concerns, consult a qualified health professional. Do not use Mihwar for emergency decisions or as a substitute for professional care.

Gemma model terms

As a condition of using Gemma through Mihwar, you must comply with the Gemma Terms of Use. The Gemma Terms govern your access to and use of Gemma in addition to these Mihwar Terms.

The Gemma Terms incorporate the Gemma Prohibited Use Policy. You must not use or allow others to use Gemma for any purpose prohibited by the Gemma Prohibited Use Policy or applicable law. You must not copy, modify, or distribute Gemma except as permitted by and in compliance with the Gemma Terms.

Gemma is provided under and subject to the Gemma Terms of Use found at ai.google.dev/gemma/terms

Mihwar includes the required Gemma notice in the app bundle and displays it with the model download controls and in How Mihwar Works.

Paid access

The price, billing period, renewal terms and any eligible offer are shown by StoreKit in Mihwar and on Apple's confirmation sheet before you purchase. A trial is available only if StoreKit says your Apple Account is eligible and displays that offer before confirmation.

Mihwar Pro Annual

This is an auto-renewing subscription for the period StoreKit displays. Apple charges your Apple Account at confirmation and at renewal. You can manage or cancel it in your Apple Account subscription settings. Cancellation stops future renewals and does not normally end access before the paid period expires.

Mihwar Pro Lifetime

Lifetime is a one-time, non-renewing purchase with no recurring charge. "Lifetime" is the product name. It means paid access while the Mihwar Pro product remains available and can operate on a compatible Apple device and operating system. It does not mean your natural life and does not guarantee that the app, updates, App Store availability or compatibility will continue indefinitely.

We will not retrospectively convert a completed Lifetime purchase into a subscription. We will not retrospectively remove paid access from a valid StoreKit entitlement through a change to these Terms. Device, operating-system and App Store changes outside Mihwar's reasonable control can still affect installation or operation.

Billing and refunds

Apple processes payments and administers purchase and subscription refund requests. You can submit a request at reportaproblem.apple.com or contact Apple Support if that route is unavailable.

Apple's refund process does not replace or limit your legal remedies under the Consumer Rights Act 2015 or another consumer law that applies to you when the app does not conform to the contract. This applies to annual subscriptions and Lifetime purchases. Email Mihwar if Apple's route does not resolve a statutory-rights issue.

Responsibility when something goes wrong

We are responsible for loss or damage you suffer that is a foreseeable result of our breach of these Terms or our negligence. A loss is foreseeable if it was clear that it might happen when the agreement was made, or if both you and Mihwar knew it might happen.

We are not responsible for a loss that was not foreseeable when the agreement was made, or that was caused solely by an event outside our reasonable control where Mihwar was not at fault. If an event outside our control materially affects a paid feature, we will take reasonable steps to reduce the effect and tell you when practical.

Mihwar is supplied for personal, non-commercial use. We are not responsible for business losses, lost profits, lost business, business interruption or lost business opportunity arising from consumer use of the app.

Sections 47 and 65 of the Consumer Rights Act 2015 prevent Mihwar from excluding specified digital-content liabilities or liability for death or personal injury caused by negligence. Nothing in these Terms excludes or limits those liabilities, fraud or fraudulent misrepresentation, your statutory rights, or any other liability that legislation prevents us from excluding.

Your content and backups

You keep ownership of content you enter into Mihwar. The app stores content locally by default. You control optional iCloud sync. You also decide when to export content or back up your device. These choices do not exclude Mihwar's responsibility where a loss is caused by our breach or negligence.

Acceptable use

Mihwar is licensed for personal use under Apple's Standard EULA. You must not resell or sublicense the app, use it to break the law, or interfere with its operation. Apple's restrictions on copying and reverse engineering do not apply where legislation or a relevant open-source licence gives you permission.

Privacy

The Privacy policy explains how Mihwar processes information and which features remain optional.

Changes to these Terms

We may make limited changes to reflect legislation, security needs, Apple platform requirements, or a change to Mihwar's features. We will explain the reason and give reasonable notice before a material change takes effect. This process follows the CMA's fair-contract guidance on variation terms.

A change will not retrospectively alter a price already paid or remove access already bought. If legislation or the nature of a change requires a fresh agreement, we will ask you to accept it. Your silence is not acceptance, and simply continuing to use an installed paid version does not create acceptance where a fresh agreement is required.

Governing law and courts

The laws of England and Wales govern these Terms. If you live elsewhere, you keep any mandatory consumer protection provided by the law of your home country. You may bring proceedings in the courts where you live where that law gives you the right to do so.
